 Harford Duracool’s (Harford) Express Limited Warranty, stated below, is exclusive, is expressly in lieu of, and excludes all warranties (express and implied) and representations of quality or service, including, without limitation, warranties of MERCHANTABILITY and Fitness for a Particular Purpose. There are no warranties by Harford other than the following Express Limited Warranty. Harford expressly disclaims, Harford’s liability to Buyer does not include, and Buyer expressly waives, all other remedies, warranties, guaranties (expressed or implied) arising by law or otherwise, other than Harford’s repair or replacement of parts under Harford’s Express Limited Warranty as described below. If any provision hereof is held ineffective by final judgment for any reason, the remainder of Harford’s Express Limited Warranty, Disclaimer and Agreed Limitation of Remedies shall remain fully effective.
No merchandise may be returned to Harford without factory supplied Returned Goods Authorization (RGA). Returned goods shipment must be prepaid and is subject to a handling charge (60 Day Validity Limit). Returned Goods Packaging must be marked with the RGA number on outside of package. Under no circumstances will Harford authorize and/or accept return of (for credit or exchange) special order (non-standard) items expressly provided for a particular order.
We make every effort to ship on date scheduled, and to maintain production schedules consistent therewith, but we are not liable for claims of damage due to failure to meet scheduled shipping date or time of delivery.
All goods are shipped FOB, Factory (including freight allowed shipments). Harford is not responsible for damage to equipment in transit. Purchasers are warned against receipting for equipment before making careful inspections. Claims for shipping damages must be made by the consignee with the carrier.
It is expressly understood Harford is not responsible and will not be held liable for damage and or injury caused to buildings, contents, products or persons by reason of the installation of any of Harford’s products.
STATEMENT OF EXPRESS LIMITED WARRANTIES
PANEL LIMITED WARRANTY - 10 YEARS: Harford warrants to the original purchaser/user its poured-in-place urethane panels to be free from defects in material or workmanship under normal use and service for a period of ten years form date of original shipment. In the event of failure, the obligation of Harford shall be limited to repair or replacement of the defective product at its option, f.o.b. factory. Inspection by Harford shall be final in determining warranty status. The warranty does not include any labor charges for making in-warranty repairs or exchange of defective parts. This warranty is in lieu of any other warranty, express or implied, including merchantability or fitness and of all other obligations or liabilities whatsoever. Under no circumstances whatever shall Harford be liable to purchaser/user for any special or consequential damages.
REFRIGERATION LIMITED WARRANTY - 1 YEAR: Harford warrants to the original purchaser/user the refrigeration equipment manufactured and sold by it to be free from defects in material or workmanship under normal use and service for a period of one year from date of installation, (but not to exceed fifteen months from date of original shipment). In the even of failure, the obligation of hlarford shall be limited to repair or replacement of any part of sold equipment, which then proves to be defective, based on inspection by Harford. This warranty does not include any labor charges for making in-warranty repairs or exchange of defective parts. This warranty is in lieu of any other warranty, express or implied, including merchantability or fitness and of all other obligations or liabilities whatsoever. Under no circumstances whatever shall Harford be liable to purchaser/user for any special or consequential damages.
ADDITIONAL FOUR-YEAR COMPRESSOR WARRANTY: Included at time of original purchase. Not available outside the United States.
1. Harford will not authorize nor accept a defective compressor returned to factory.
2. When a compressor failure occurs in the field, the old compressor is to be exchanged at the local wholesaler that represents the manufacturer of compressor. The service company purchases the replacement unit if the serial number on the compressor is over 12 months old. (Example: 93B is Feb of 1993; A - Jan., B - Feb., C- March, etc.) The local wholesaler will not honor Harford’s warranty! Harford’s customer or the refrigeration contractor purchases the compressor. Harford reimburses in accordance with number six.
3. If the compressor is less than one year old, an over the counter exchange is made at no cost. Harford must receive documentation in accordance with number six.
4. For Semi-Hermetic Units, the wholesaler will issue a salvage credit memo for the defective compressor - only.
5. Hermetic units that fail after 12 months from date of shipment or 20 months of manufacture, have no salvage value. The old compressor serial number plate from the top of the compressor and the wholesaler’s invoice for the new unit must be furnished.
6. To receive reimbursement, Harford requires a copy of the invoice for the new compressor from the wholesaler (not the service company’s) and the salvage credit memo. The following information must be included:
a. New compressor serial numbers
b. The amount paid
c. Defective compressor serial number
d. Amount of salvage credit received
e. Original Harford job number. (Example XW35OJ - found on door sticker)
7. Harford will issue a check or credit for the difference only. Labor or other miscellaneous parts are not included.
8. The service company is responsible for lawful disposal of the defective unit and refrigerant.
Provisional 30 Day Warranty
A provision to the standard warranty of Harford Duracool LLC warrants parts and labor for a period of thirty days from startup, not to exceed ninety days from date of shipment. Proof of purchase, installation contractor name, and start-up date is required before claims can be reviewed.
REFRIGERANT ALLOWANCE:
Leaks that are suspected to have originated from factory welded joints or ruptured components that were furnished as a part of the equipment, may be submitted and will be considered for reasonable charges.
The price of refrigerant will be based upon an index of wholesale prices. The index price will be based on the averages attained on a national basis.
EXCLUDED SERVICES:
At no time will Harford honor any claim for the following services:
1. Expansion valve adjustments.
2. Resetting time clocks, pressure devices or circuit breakers.
3. Defrost cycle component adjustments.
4. Labor for compressor change out other than D.O.A.
5. Pressure control or thermostat adjustments.
6. Field wiring.
7. Added components or controls.
8. Coil cleaning.
9. Service on compressor components or oil level adjustment.
10. Top-off charge.
11. Truck charges.
12. State and local taxes.
13. More than one service call for the same problem.
14. Normal maintenance items for equipment used by service companies (example: batteries, vacuum pump oil, leak detector, supplies, etc.).
15. Clean-up of iced” equipment or coils due to improper control setting or application problems.
16. Drain line heat tape.
17. Contractor mark-up above wholesale price paid by contractor for parts.
18. Contractor travel and/or wait time. |
